Council proposes to vary the lease with Wodonga Solar Power for land on the corner of Tom Tanners Road and
Eames Road and 226 Lady Franklin Road, Barnawartha North.

NOTICE OF INTENTION TO VARY LEASE
Wodonga City Council (Council) gives notice under Section 115 of the Local Government Act 2020 (Act) that it intends to vary the lease with Wodonga Solar Power Pty Ltd as described below.
The land which is the subject to the lease is corner of Tom Tanners Road and Eames Road, and 226 Lady Franklin Road, Barnawartha North, Victoria 3691 which is Lot 1 and CA 3B contained in Certificate of Title Volume 12276 Folio 919 and Volume 10962 Folio 730 which is council owned land.
The Proposal is that Council vary the lease on the following terms:
Current Term
- The rent is to be adjusted by 4.85% and CPI on each anniversary of the commencement date during the term and any further term.
- The rent is to be adjusted:
- by CPI on each anniversary of the commencement date during the Term, the further Term and any over holding period; and,
- a market rent review undertaken every 5 years on each anniversary of the commencement date during the Term, the further Term and any over holding period and on the commencement date of each further Term.
Proposed Term
This variation will come into effect on 1 July 2022.
A person may make a submission on the Proposal. Any person proposing to make a submission under section 115 of the Act must do so by 5pm on 17 November, 2021.
All submissions will be considered in accordance with section 115 of the Act.
