A deviation of Coyles Rd on McFarlane’s Hill is proposed to correct an anomaly in which part of the road is located outside
the actual road reserve on the title.
The section of road is from the Felltimber Creek Rd end.
The error was detected in 2019 by the Department of Environment, Land, Water and Planning (DELWP), which proposes to close the existing road and reconstruct it within the newly proclaimed road title.
The existing road reserve will be incorporated into the McFarlane’s Hill Reserve as unreserved Crown land.
The process required to make this change is contained within the Land Act 1958, Local Government Act 1989 (the Act) schedule 10, clause 2 and requires that a Public Notice be published in a local newspaper in accordance with section 223 of the Act.
Upon completion of the road deviation, the original road becomes unreserved Crown land which will then enable the Department of Environment Land Water and Planning (DELWP) to reserve that land as part of the Regional Park.
This consultation is being conducted in accordance with section 223 of the Local Government Act 1989.
Any submissions received will need to be considered by the council.
